فى شهر النساء وجب علينا أن نتحدث فى المحور القانونى ونسلط الضوء على المعاناة التي مازالت تلاحق الكثير والكثير من النساء فى أروقه المحاكم لكى تقتنص حقوقا مشروعة لها ولأطفالها، وبالرغم من حديث البعض عن أن المرأة قد تحصلت على كافة حقوقها بالقانون، إلا أننى أرى بصفتى ومن طبيعة عملى أنها وإن حصلت على بعض الحقوق المكفولة بقوة القانون إلا أنها كثيرا ما تكون حبرا على ورق وأنها لم تدخل بعد حيز التنفيذ المطلق.

فهناك الكثير من المعوقات التشريعية والنصوص الجامدة الغير مفعلة بقانون الأحوال الشخصية ونصوصه التى أراها باتت مفتقرة إلى الواقعية؛ بل أصبحت شبه أطلال لزمن انقضى لا مواكبة فيها للمتغيرات الاقتصادية والاجتماعية التى فرضت نفسها لتصبح معها عاجزة عن مسايره أي أعباء.

وقد حرصنا منذ سنوات على مناداة السلطة التشريعية وما لها من دور وطنى فى تعديل الإطار التشريعى لأن القانون ليس فقط وليد قناعات شخصية لأفراد بعينهم ورؤياهم؛ بل هو مرجعية لتشكيل الرؤى والقناعة حال وضعه واستقراره مدة من الزمن، وكذلك هو الأداة التنظيمية الأهم فى المجتمع وهو الكفيل بتحويل الأفكار إلى نظم وقواعد سلوك، لذلك فإن ثورة تشريعية نحو إقرار العدل والإنصاف تجاه المرأة لهو أمر شديد الأهمية فى تقرير وضع المرأة الآن ومستقبلا..

وحتى وإن حالت الإعتبارات الثقافية أحيانا دون تفعيل بعض النصوص القانونية أو تجهيلها فإن حركة متوازية ومستمرة تضم فاعليات مجتمعية مختلفة من شأنها أن تضع تلك النصوص موضع التفعيل، مما يحفظ للمرأة حفظ كرامتها وحقوقها.

وأخيرا تمنياتى لسيدات مصر العظيمات وخاصة منهن المعيلات بالعيش فى حياة كريمة تليق بكونهن نواة المجتمع ومربيات لأجيال لابد وان تكون بذرة صالحة ترعى فى بيئة صالحة طيبة تكفلها الدولة المصرية

In the women’s month, we have to talk about the legal aspect and shed light on the suffering that continues to haunt several women in the courts to obtain legitimate rights for themselves and their children.

 Although some people say that women have obtained all their rights by law, I see as a lawyer that even if they got some rights guaranteed by the force of law; they are often just a scrap of paper and haven’t yet come into effect.

There are legislative obstacles, and deactivated rigid provisions in the Personal Status Law and its texts, which I see have become lacking in realism, rather they have become almost ruins for a passed time, in which they do not keep pace with the economic and social changes that imposed themselves, making them unable to cope with any burdens.

We have been keen for years to call on the legislative authority and its national role in amending the legislative framework. Because the law isn’t only the result of specific individuals’ convictions and visions, but it is a reference for shaping views and beliefs if it is established and stable for a while. It is also the most significant organizational tool in society, which is the guarantee of transforming ideas to systems and rules of conduct. Therefore, a legislative revolution towards establishing justice and fairness towards women is a very important matter in determining the status of women now and in the future. Even if cultural considerations sometimes prevented the activation or disregard of some legal texts, a parallel and continuous movement that includes various societal actors would put these texts into effect, thus preserving women’s dignity and rights. Finally, I wish the great women of Egypt, especially the breadwinners, to live a decent life befitting them as they are the nucleus of society and educators for generations that should be raised in a good environment guaranteed by the Egyptian state.
